EULA - End User License Agreement

LICENSE

Haxar Limited (HAXAR) hereby gives you (THE CUSTOMER) a non-exclusive license to use the software Bamboo File Sync and Backup (THE SOFTWARE).
For Free Edition of THE SOFTWARE (THE FREE EDITION), the license is granted, and is time-unlimited. THE FREE EDITION usage is subject to both the limitations as described below, and the limitations listed at URL http://www.BambooSync.com/channel/index.php/faq/editions-and-license/ which is subjected to change without further notice from or obligation on HAXAR.
For registered Professional Edition of THE SOFTWARE (THE PRO EDITON), THE CUSTOMER has to pay a license fee, by following instructions prompted by the program or website at URL http://www.BambooSync.com. THE PRO EDITION usage is subject to the limitations as described below.

THE CUSTOMER may:
- install and use THE FREE EDITION on any number of computers;
- use THE PRO EDITION on up to the number of licensed computers specified at the time of purchase;
- uninstall THE PRO EDITION on a licensed computer to free up a licensed computer count, so that the licensed computer count could be reused on another computer;
- copy THE SOFTWARE for archival purposes, provided any copy contains all of the original software's proprietary notices.

THE CUSTOMER may not:
- permit other individuals to use THE SOFTWARE except under the terms listed above;
- modify, translate, reverse engineer, decompress, decode, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction) THE SOFTWARE;
- modify, translate, reverse engineer, decompress, decode, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction) the proprietary system data, memory, or data file generated by THE SOFTWARE;
- create derivative works based on THE SOFTWARE;
- copy THE SOFTWARE (except as specified above);
- rent, lease, transfer or otherwise transfer rights to THE SOFTWARE;
- remove any proprietary notices or labels on THE SOFTWARE.
TERMINATION

The license will terminate automatically if THE CUSTOMER fails to comply with the limitations described above. On termination, THE CUSTOMER must destroy all copies of THE SOFTWARE and Documentation.
DISCLAIMER OF WARRANTY

THE SOFTWARE is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement.
The entire risk as to the quality and performance of THE SOFTWARE is borne by THE CUSTOMER.
Should THE SOFTWARE prove defective, THE CUSTOMER but not HAXAR assume the entire cost of any service and repair.

HAXAR IS NOT RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

Title, ownership rights and intellectual property rights in and to THE SOFTWARE shall remain in HAXAR. THE SOFTWARE is protected by international copyright treaties.
